​Akaroa Bank and the Queen’s Trust Account

Lecture by Hohepa Mapiria, Maori Chief Justice
​Part 1 - October 2003
Question: They leased N.Z. to the colonialist (colonies)...     Who are the  subjects to the Queen?...    Is it them or us?
Hohepa:
No, no, no, the subjects are the government, New Zealand Company, which is the New South Wales Parliament presiding in New Zealand. She (Her Majesty Victoria)  leased the colonies, only the colonies, where the subjects had actually purchased land from the Crown, but the Crown never purchased any [land] from the Maori.  So, the Crown leased to them by warrant as trustee.  She  
(Her Majesty Victoria) leased the land to them by warrant and made them pay taxes, the [New Zealand] government.  So they paid taxes to the Queen and She (Her Majesty Victoria) set up a bank in England called The Bank of New Zealand and every year She was transferring the funds into a bank here called Akaroa, but there was nobody who was administering that bank.  So the government here put the Reserve Bank of N.Z over the top of Akaroa bank, and they were taking the putea (money) the first two payments, and then the Queen saw that, and she started another bank account in the United Nations, and she started to transfer the putea into that bank. She appointed the King and Queen of Spain and one of Her children as trustee(s).

Question: So the money in the Akaroa Bank now runs into millions of dollars, is it?
Hohepa: Multi billion dollars! Trillions.

Question: How do we get access to this money?
Hohepa: Whoever sets up the right government, recognisable to the crown, then the combination to that account is handed over to that government.

Question: Providing that we have the right government?
Hohepa: Yeah, and its handed over to that government, to run that country, for the benefit of that country, its ours, but while its sitting there the interest has been deposited into the Akaroa Bank.

Question: Isn’t the government the one that is taking the interest away from that money ?  Can they have access to that interest?
Hohepa: But they are.

Question: I believe they cannot get that money but they can get to the interest of that money - is that right? So they are spending our money?
Hohepa: Yeah, that is why they have got the Reserve Bank, the interest that is in the Reserve Bank, they are taking it out, of the Reserve Bank they use it to govern the nation.  They got no money, and it’s all our putea.
 
Question: That’s why Kohuiarau are trying to get access to this money?
Hohepa: Only a government that is recognised by the Queen, if it is not in the interest of the Maori people of Aotearoa, then they won't get there hands on it.

Question: Well, the Maori Queen?
Hohepa: No, no, no.   If,  
for instance,  the government, they can’t get there hands on it, because its not recognisable and the government withholds the interest of the Maori people, they have not been mandated by the Maori people and neither has Kohuiarau.  They have not taken the time to represent the Maori on the basis of Mana Whenua and Mana Tangata, because the Queen (Her Majesty Queen Elizabeth II) knows about the Sovereignty, which is based on Her Sovereignty to the soil, so Mana Whenua comes before Mana Tangata.  But because, this is why, when we set up our corporation, we say, what whenua have you got, when the Nga Tikanga Maori Law Society says, what whenua have you got, show me, ae kei te pai, you got Mana Whenua, where is it, ae kei te pai, who are the tangata in the whenua, oh it's on this paper, ae.  See it's not like Kohuirau.  They say, what’s your name?  Well, kei te pai, you’re on the registry, they got Mana Tangata and no land.  When the Queen (Her Majesty Queen Elizabeth II) sees the papers, She says, when you test Her sovereignty, when She applies for incorporation, She will say, all of England and Ireland, here’s the papers, then She says, here’s Scotland, so the Queen  (Her Majesty Queen Elizabeth II)  says, here’s my Mana Whenua, and they say where’s the people? and she says, all of the people of England, Ireland, Scotland, and the ones that had [been] left down in Australia, and all over the world are her subjects, and these are the colonies. We are lucky to have drawn a treaty with the Queen (Her Majesty Victoria) like that one.  Every other indigenous nation has peace treaties, like Canada,  they have separate peace treaties within their Indian tribes with England, one tribe will have a peace treaty which is different from another tribe. There’s a different peace treaty with the Crown.
